Drainage Board

The mission of the Montgomery County Surveyor's Office and Drainage Board is to assure that the County's regulated drain system complies with State and County laws and professional drainage standards; provides adequately functioning and financially sound drains; and earns public and landowner trust.

Drainage Board established: There is established a drainage board that shall act in the name of the Montgomery County Drainage Board.  Authority: the Drainage Board is governed by Indiana Code 36-9-27.

Membership: The Montgomery County Drainage Board shall consist of five (5) members appointed by the Board of Commissioners. One (1) member shall be a Montgomery County Commissioner.  Four (4) members shall be residents of Montgomery County who are freeholders and who are knowledgeable in drainage matters.  Of the four freeholders at least one shall be recommended to the Board of Commissioners by the Board of Montgomery County Soil and Water Conservation District (provided, however, the Board of Commissioners retains discretion to appoint or reject the recommendation); one shall be a resident who lives in either Coal Creek, Madison, Sugar Creek, Wayne, North Union or Franklin townships; one shall be a resident who lives in either Ripley, South Union, Walnut, Brown, Scott or Clark townships.  The four freeholders shall serve for terms of three (3) years with their initial appointments made so as to provide for staggering of terms on an annual basis.  (Ordinance 2007-1, April 9, 2007)

Board practice: the Drainage Board may establish practices consistent with its authority under Indiana law.

Duties:

Through the Drainage Code, the County Drainage Board and the County Surveyor are responsible for the maintenance and operating functions of all Regulated Drains, open and tiled, in the county. Each year, the County Surveyor must report on the condition of each Regulated Drain and, if necessary, recommend maintenance or reconstruction projects to the Drainage Board. The Drainage Board and the Surveyor must also respond to petitions by the public to create or dedicate new Regulated Drains, reconstruct existing Regulated Drains and perform regular maintenance activities.
