MONDAY, SEPTEMBER 24, 2007

MINUTES

The Montgomery County Drainage Board met on Monday, September 24, 2007 in the conference room of the Crawfordsville Public Library, Crawfordsville, Indiana.

Those members present were as follows: Commissioner Phil Bane, Chairman; Commissioner William D. McCormick, Vice Chairman; Deanna Durrett, Member/Executive Secretary; Dave Rhoads, Member; Surveyor Tom Cummins; and Drainage Board Secretary Lori Dossett.

Also present: Drainage Board Attorney Suanne Milligan; Aleasha Shelley, Journal-Review; Building Administrator Marc Bonwell; Ron Cunningham, Pat Cunningham-Vester & Associates; Richard Harshbarger; Kenny Pearson; Derrick Thompson; Glen Thompson, Dennis & Valarie Rose; Rob Durrett; Larry Gentry; Brenda Foster; Clint Wilkins; Barry Burkhart; Brad Grayson; Merlin Cox; and Marian Lindow-League of Women Voters.

Chairman Phil Bane called the meeting to order @ 6:30 p.m. and led the Pledge of Allegiance and Pastor Terry led the prayer.

Basil VanCleave Drain

Surveyor Cummins recommended to the Board to destroy the old Basil VanCleave tile between CR600S and Vine Street, to cap off the breather at the railroad crossing south of CR600S, cap off the inlet on the east side of CR100W at the same point and to examine the condition of the tile beneath CR600S to determine whether jetting the tile is warranted and report back to the Drainage Board in October. After discussion from property owners Brad Grayson, Derrick Thompson, Kenny Pearson, Barry Burkhart; Valarie Rose and Town of New Market Board Member Merlin Cox, Deanna Durrett moved to accept the surveyor's recommendation concerning the Basil VanCleave Drain using the Basil VanCleave maintenance fund and Bill McCormick seconded. After further discussion, Durrett withdrew her motion and McCormick withdrew his second. Dave Rhoads moved to replace the Basil VanCleave tile between Vine Street and Main Street under the swale to the railroad crossing south to Watson's property. Jack Grimble seconded. 4 votes in favor 1 vote opposed (McCormick).

Dave Rhoads moved to replace the Basil VanCleave tile to CR100W. Jack Grimble seconded. The Board discuss that a Petition to Reconstruct has not been signed and received by the Board making the request to replace the Basil VanCleave tile to CR100W. Dave Rhoads withdraws his motion. Jack Grimble withdraws his second. Motion carried.

The Board received Kenny Pearson's submitted Petition to Reconstruct a portion of the Basil VanCleave Drain along CR100W.

James Sanders Drain

A reconstruction order was entered by the Drainage Board on December 20, 2005 stating that the reconstruction loan would be paid back over a period of ten years. Reconstruction loans can only be paid back over a five year period. Bill McCormick moved to amend the December 20, 2005 Drainage Board reconstruction order on the James Sanders Drain to state that the

reconstruction loan will be paid back over a five year period. Deanna Durrett seconded. 5-0 votes in favor. Motion carried.

Landowner Informational Meeting

Landowner Informational Meeting

Deanna Durrett advised that the Landowner Informational meeting will be held on December 4th or 5th pending the availability of the 4-H Building.

Browns Valley Christian Church

Building Administrator Marc Bonwell presented a drainage plan for the Browns Valley Christian which will be located one-half mile north of Browns Valley on SR47 North. Bonwell advised that the drainage plan has been reviewed by DLZ. Jack Grimble moved to accept the drainage plan for the Browns Valley Christian Church. Bill McCormick seconded. 5-0 votes in favor. Motion carried.

Devitt Drainage Plan

Building Administrator Bonwell advised that Mr. Devitt is disputing the need for a drainage plan on his proposed 40x100 boat storage facility. Mr. Devitt requested to be on the Drainage Board agenda but he did not appear.

Staff Reports

Farm Bureau - Drainage 101

Deanna Durrett advised that seven Montgomery County people attended the Drainage 101 class hosted by Farm Bureau on September 5th and she sent a comment to letter regarding the class content.

Illegal Hookup Committee

Deanna Durrett advised that the Illegal Hookup Committee met for the first time today regarding private tiles hooked onto County drains illegally.

Subdivision Ordinance Committee

Deanna Durrett advised that she is in the process of forming the Subdivision Ordinance Committee and will report to the Board after its first meeting.

Odis Stafford Drain

Surveyor Cummins advised that he has received two bids for repairs to the Odis Stafford Drain. Foster Farm Drainage, Inc. - $2,562.20 & Maxwell Farm Drainage, Inc. - $2,168.20. Deanna Durrett moved to accept the Maxwell Farm Drainage, Inc. bid of $2,168.20. Dave Rhoads seconded. 5-0 votes in favor. Motion carried.

Bill McCormick moved to adjourn. Jack Grimble seconded. There being no further business before the Drainage Board, the meeting was adjourned. 5-0 votes in favor. Motion carried.
